Under Virginia Code section 8.01-50, wrongful death is defined as death that has been caused by a third party’s “wrongful act, neglect, or default.” Essentially, if someone acts in a way that a reasonable person would not have, and that action ends someone else’s life, then it could constitute a wrongful death case.
