Distracted Driving and Motor Vehicle Negligence

Under the common law rules of Virginia’s courts, a person has a duty to exercise reasonable care to avoid causing other people foreseeable injuries. When a person breaches this duty and causes a reasonably foreseeable injury, they are liable for damages that arise from such injury.

Furthermore, Section 46.2-1078.1 of the Code of Virginia was recently added to address texting while driving. Under the statute, “it is unlawful for any person to operate a moving motor vehicle on the highways in the Commonwealth while using any handheld personal communications device to:

  • Manually enter multiple letters or text in the device as a means of communicating with another person; or
  • Read any email or text message transmitted to the device or stored within the device, provided that this prohibition shall not apply to any name or number stored within the device nor to any caller identification information.

Courts have held that the violation of the motor vehicle code is evidence that someone breached their duty to exercise reasonable care to avoid injuring others. Thus, when someone violates Section 46.2-1078.1 and injures another person as a result, they will be found liable for their damages.
