Liability in a personal injury case

One of the most important elements of a personal injury case is determining fault. Once fault is established, the at-fault party will need to pay compensation to the injured party, whether it is negotiated or settled in court. A plaintiff can prove fault in a variety of ways, but a few essential elements must be proven in order to find a party liable:

  • That the defending party owed you a duty of care
  • That this duty that was owed to you (the plaintiff) was breached
  • That the cause of the plaintiff’s injuries was this breach of duty
  • That the plaintiff suffered damages, such as missed wages from work or medical bills

How long do i have to file a personal injury case?

Each state has a specific time period in which you are entitled to file a personal injury lawsuit and pursue the compensation you deserve. If this deadline passes, you will be barred from being able to file a claim. In Virginia, under Virginia Code § 8.01-243, the deadline to file a personal injury claim is two years. The court could refuse to accept the personal injury claim if it is filed after this time.
