Slip & FallThese types of claims are often referred to as slip and fall cases and they generally result on the premises' of the business where an individual is attempting to conduct business, such as purchasing a product from a local grocery store.

The owner of a business has a duty to protect an invitee, from known hazards or conditions on the premises, which the owner knew or should know that are likely to cause injury to a customer.

These types of injuries can occur from the failure of the business owner to clean up spills on the floor or to make sure that objects placed in the business for sale are done so in such a manner that they do fall over and cause injury to customers. In these types of claims it is very important that the attorney get all of the facts to determine exactly caused a person to be injured.

If you are injured on the property of a business you should always report the injury if possible at the time it occurs and if you are requested to provide a written statement it is important to be specific as to what exactly caused your injury. You must be mindful, that many businesses employ risk management personnel whose job it is to protect the property owner.

If injured while at a place of business always attempt to make an independent record of your own as to what caused you to be injured. It is always helpful to write down the name of the employee of whom the injury is reported to, along with the names of any witnesses who may have seen the injury. Always ask for a copy of any document that is prepared which records the incident and make sure the written document accurately reflects what did occur. If the store manager or employee fills out the incident report incorrectly insist that changes be made to accurately reflect your version of events.

Be mindful to listen to any statements made by store employees and do the best you can to record any and all statements that are made. For example if a store manager makes a statement such "I told the maintenance personnel to fix this condition or problem at an earlier date or time." You would want to make a note of what the employee says and attempt to get the name of the person making the statement.
